In accordance with Law No. 98/2015, of August 18, of the Legal Regime of Jewelery and Assay Shops (RJOC), an article containing precious metal is legally marked when it bears the marks/symbols of the following hallmarks:
Responsibility, manufacturing mark or equivalent;
Assay mark and touch mark.
As expressed in Article 3 of the RJOC, paragraphs:
«Assay hallmark», a hallmark that contains the engraving corresponding to the Assay Office or the independent testing and marking organization that uses it and that corresponds, in general, to a certain metal and legal touch, used to certify articles with precious metals with legal touches, under the terms and for the purposes provided for in the RJOC;
«Manufacturing Responsibilityor equivalent hallmark», a hallmark that contains the engraving identifying the person responsible for placing the article with precious metal on the domestic market;

TRADEMARKS FROM OTHER EU OR EEA COUNTRIES
Items containing precious metal from a Member State of the European Union or the European Economic Area may be sold on the national market without the need for testing and marking by the Assay Office, if provided their comply with the requirements expressed in Article 11 of the RJOC:
Manufacturer's responsibility mark or equivalent;
Assay mark and touch mark, when the former does not include the touch;
Deposit in the Assay Office of the document proving the registration of the respective brand of responsibility, of manufacture or equivalent in the country that carried out the control and quality assurance;
Recognition by the Portuguese Institute of Quality, upon favorable opinion of the Director of Assay, of the following cumulative requirements:
• The information content of the touch guarantee marks, contrasting mark and touch mark, is equivalent to the touch guarantee marks established in the RJOC;
• The informational content of guarantee of touch mark, assay mark and touch mark is not likely to mislead the consumer;
• The marking conditions for guarantee of touch mark, applied by the independent testing and marking body in the country that carried out the quality control and assurance, are equivalent to those established in the RJOC.

Articles with precious metals from a Member State of the European Union or the European Economic Area (EEA) that are exempt from marking under the terms of the respective legislation, but which are not exempt from marking under Portuguese legislation, must be previously tested and marked at a Portuguese Assay Office or at a recognized Assay Office in the country of origin, so that they can be placed on the national market.
